The fee for participants who have previously attended training at our University is TRY 900.

1. Basic concepts of enforcement and bankruptcy law, and concordat law
2. Accounting, finance and business management
3. Qualifications required of commissioners,
4. Duties, powers and obligations of commissioners, and their civil and criminal liability,
5. Analysis, implementation and supervision of the concordat project,
6. The creditors’ committee and its duties,
7. Business management,
8. Accounting,
9. Analysis of financial statements and business operations,
10. Crisis management in businesses,
11. Conduct of the concordat process,
12. Reports to be prepared during the concordat process,
13. Report writing procedure and technique

 

Purpose of the training:

As an authorised provider of basic training for concordat commissioners, to deliver the training in accordance with the Procedures and Principles of Basic Training for Concordat Commissioners of the Department of Expert Witness Affairs dated 26/06/2019. 

Qualifications of concordat commissioners:

Under the Regulation on Concordat Commissionership and the Creditors’ Committee:

ARTICLE 4 – (1) A commissioner must meet the following requirements:

a) Being a Turkish citizen.

b) Having full legal capacity.

c) Having graduated from a faculty providing at least four years of undergraduate education or from a domestic or foreign institution whose equivalence has been recognised by the Council of Higher Education, and having no less than five years of professional experience.

ç) Not having been declared bankrupt.

d) Not having been removed from the office of commissioner within the last three years for failure to exercise the due care required by the position.

e) Not having been dismissed from a profession or the civil service on disciplinary grounds, and not being banned from practising a trade or professional activity.

f) Not being banned from public service.

g) No provision in the legislation governing the profession actually practised that prevents serving as a commissioner.

ğ) Even if the periods specified in Article 53 of Turkish Penal Code No. 5237 of 26/9/2004 have elapsed, not having been sentenced to imprisonment for more than one year for an intentional offence, or, even if pardoned, not having been convicted of offences against the security of the State, offences against the constitutional order and its functioning, embezzlement, extortion, bribery, theft, fraud, forgery, breach of trust, fraudulent bankruptcy, bid rigging, rigging the performance of an obligation, laundering of assets derived from crime, smuggling, false expert testimony or interpretation, perjury or false oath.
h) Having no affiliation or connection with terrorist organisations.

ı) Without prejudice to Article 13 of this Regulation, having completed the commissioner training.

Certificate / Certificate of Attendance:

At the end of the programme, participants are entitled to a certificate approved by the Faculty of Law of the Social Sciences University of Ankara.

Attendance requirement:

Training institutions keep an attendance record for each candidate, and candidates who miss 1/12 of the classes without an acceptable excuse are removed from the programme. (Procedures and Principles of Basic Training for Concordat Commissioners, Circular: 171)
